台湾一名蔡姓男子颈椎损伤四肢无力住院，并聘外籍女看护照顾，却病房浴室内突然伸出咸出手，强抱并袭胸，有意要她一起洗澡。
判决书提到，蔡男辩称，当时在复健，需要他人扶着，手无力也无力站起，且医院有监视器，不可能去抱看护，至于手机录音未显示时间，并非当日录音，是她设计的。
女看护表示，当时在帮蔡男洗澡，被要求抱他，但不愿意，他就伸手抱还故意触摸胸部，且双手环绕到背部，想要推开他，但又怕他生气，就被质问为何不让他抱，还说“有看到你与别的男生在一起”。
一审认为蔡男住院期间可用筷子取食眼前的食物，可独力完成洗脸、洗手、刷牙及梳头发动作，并可独立行走，因此他乘隙做出短暂触摸看护，无需耗费自身多大力气，事后又狡辩，因此判他2月徒刑，得易科罚金。
高院审理时，认为蔡男提起上诉仍执前词否认犯罪，经原审列举事证逐一论驳，加上原审量刑亦称妥适，因此驳回上诉。
